CONTEST Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. PURCHASE DOES NOT IMPROVE ODDS OF WINNING. VOID WHERE PROHIBITED.

1. SponsorS: The participating franchised Operators of Chick-fil-A restaurant businesses in the San Antonio, New Braunfels, Kerrville, Eagle Pass, and Del Rio Texas area (collectively “Sponsors”).

2. Eligibility. The Chick-fil-A San Antonio Remarkable Teacher Award Contest (“Contest”) is open to legal residents of the United States (“U.S.”) and the District of Columbia (“D.C.”), excluding residents of Arizona, who live in the U.S. or D.C. and are thirteen (13) or over as of April 8, 2024 (“Entrant(s)”). Employees and their immediate family and household members (whether or not related) of Sponsors, Chick-fil-A, Inc., CFA Properties, Inc., and any Chick-fil-A, Dwarf House®, and Truett’s Grill® restaurants, and any of their Operators, employees, affiliates, subsidiaries, advertising and promotion agencies, Contest Administrator, and all other entities or individuals associated with the development, administration, or fulfillment of the Contest (collectively, “Contest Entities”) are not eligible to participate in the Contest. All federal, state, and local laws and regulations apply.

3. How to Enter. Contest begins at 6:00:01 a.m. Central Time (“CT”) on April 8, 2024, and ends at 5:00 p.m. CT on April 12, 2024 (“Contest Period”). All entries must be received in the manner described in these Official Rules during the Contest Period to be eligible for prizes.

If you are a current or former student of a current educator in: (a) the greater San Antonio, Texas area (specifically, San Antonio, New Braunfels, and Kerrville); (b) Eagle Pass, Texas; or (c) Del Rio, Texas who is remarkable and has demonstrated one of more of the following criteria (listed below in a-d), visit www.sanantoniocfa.com/remarkableteachers (the “Contest Website”) during the Contest Period and follow the entry directions to submit your nomination (“Nomination”).

Criteria for Nomination:

The educator has had a personal, academic, and/or inspirational impact on one or more students.
The educator has a passion for the teaching profession, as demonstrated by going beyond expected duties.
The educator has shown innovation and creativity in the classroom.
The educator plays a leadership role in his/her school and community.

Limit one Nomination per person regarding a specific educator; i.e., Entrants may submit two or more Nominations concerning two or more separate educators but may not submit two or more Nominations concerning the same educator. Submission of multiple Nominations by or on behalf of the same Entrant concerning the same educator will result in ineligibility with respect to all Nominations submitted by or on behalf of that Entrant regarding the same educator. An Entrant may only submit a Nomination regarding someone else; i.e., an Entrant may not submit a Nomination about himself/herself.

Prior to entering the Contest, potential Entrants must acknowledge that they agree that each Nomination submitted by them will become the exclusive property of Sponsors immediately upon submission.

4. GENERAL RULES. Once a Nomination has been submitted pursuant to this Contest, the Entrant (or anyone else acting on behalf of the Entrant) may not distribute, disseminate, sell, use, license, or post the Nomination or any copies thereof in any medium (including other Internet sites) without the prior express written consent of Sponsors. All Nominations (including all material embodied therein) submitted to Sponsors shall automatically become the sole and exclusive property of Sponsors immediately upon submission. All Nominations submitted in connection with this Contest will be reviewed to ensure compliance with these Official Rules. Sponsors shall have absolutely no obligation to give feedback or reasoning regarding why a Nomination is not selected as a potential winning nomination.

Nominations must not infringe any rights of any third party including, without limitation, copyright, trademark, and rights of publicity and/or privacy. Nominations must be in English and cannot contain any videos, photographs, or images. By submitting a Nomination in the Contest, each Entrant represents and warrants that these requirements have been met. Failure to satisfy these requirements, as determined in Sponsors’ sole and absolute discretion, may result in ineligibility with respect to all Nominations submitted by or on behalf of that Entrant. Incomplete and/or duplicate Nominations are not permitted and will be deemed void. The use of any device to automate the entry process is absolutely prohibited, and any such Nominations shall be void.

5. SELECTION OF WINNERS. From approximately April 29 - May 3, 2024, a panel including Sponsors and their designees will review all eligible Nominations and select three (3) Winners on May 7, 2024. The educators described in each Winning Nomination (each, a “Winner”) will be selected based on a number of factors including: (a) the educator’s personal, academic, and or inspirational impact on students (40%); (b) the educator’s passion for the teaching profession demonstrated by going beyond expected duties (30%); (c) the educator’s innovation and creativity in the classroom (20%); and (d) the educator’s leadership in his/her school and community (10%). Entrants do not have to be present at the Winners’ selection for their Nomination(s) to be deemed a winning entry or winning entries. Winners will be announced on Tuesday, May 7, 2024, on the Contest Website.

6. Prizes. Three (3) winning Nominations (“Winning Nominations” or “Winning Nomination”) will be selected from all eligible Nominations received during the Contest Period. Subject to meeting the requirements of these Official Rules, the Each Winner will receive a prize basket consisting of the following Chick-fil-A branded merchandise and items (“Prize): (a) fifty-two (52) Chick-fil-A sandwich/nugget promotional cards redeemable at participating Chick-fil-A restaurants; (b) one (1) Sticker Venture Bottle; (c) one (1) Sticker Journal; (d) one (1) pair of MVP Socks; (e) one (1) Portable Corn Hole Game; (f) two (2) Ear Mor Chikin Black Jotter Pens; (g) one (1) Chicken Sandwich Tote; (h) one (1) Microfleece Blanket; (i) one (1) Chick-fil-A Camper Mug; (j) one (1) Chicken Sandwich Lanyard; (k) Chicken Sandwich Wrist Lanyard; and (l) one (1) pair of Pickle Pickle Socks. Verifiable Retail Value (“VRV”) of each Prize is $577.59 total VRV of all Prizes: $1732.78. All other expenses not specifically mentioned herein, including but not limited taxes, are the sole responsibility of each Potential Winner.

7. HOW TO CLAIM PRIZES. From approximately May 8 - 13, 2024, Sponsors or their designees will reasonably attempt to notify each Winner of his/her Winning Nomination by email or phone using the contact information provided in the Nomination form. To accept and receive a Prize, a Winner must complete and sign an Affidavit of Eligibility (“Affidavit”) provided to the Winner, and, where lawful, a Liability/Publicity Release (“Release”) (collectively, “Affidavit and Release”), and return by email to the Contest Administrator, a copy of the original signed and notarized Affidavit and Release within three (3) business days of notification of the Winning Nomination. If the indicated forms are not signed and returned by the time indicated on the documents, or if a Winner does not meet the eligibility criteria or is otherwise unwilling or unable to comply with these Official Rules, an alternate Winner may be selected at and in a manner to be determined in Sponsors’ sole and absolute discretion.

8. PUBLICITY. Unless prohibited by law, participation in the Contest and/or acceptance of a Prize constitutes consent of each Entrant and each Winner for Sponsors and their designees to use the name, age, school, hometown, and state of residence of Entrant or each Winner for Contest or promotional purposes in any media now known or later developed, without payment or consideration to each Entrant or Winner. As a condition of participation in the Contest and/or acceptance of a Prize, each Entrant and each Winner hereby grants Sponsors the perpetual, worldwide right to edit, adapt, modify, reproduce, publish, distribute, and otherwise use (unless prohibited by applicable law) the Nomination (including all material embodied therein) in any way or in any media now or hereafter known for trade, advertising, promotional, or other purposes as Sponsors determine, in their sole and absolute discretion, without further notice or compensation to any Entrant, Winner, or any other third parties.

9. PRIVACY. Sponsors and their designees will collect personal data from Entrants when they enter the Contest and may also collect some personal data about the nominee in the Nomination, and this information will be used and/or disclosed for the purposes of administering the Contest, publicizing the Contest, and other promotional purposes that benefit the Sponsors.

10. GENERAL CONDITIONS. By participating in this Contest, being selected as a Winner, or by accepting a Prize, each Entrant and each Winner agrees to be bound by these Official Rules and the decisions or interpretation of Sponsors regarding the Official Rules, which are final and legally binding in all respects. In the event that a Prize cannot be awarded for any reason or a Potential Winner is not capable of redeeming a Prize for any reason, Sponsors shall not be obligated to award any Prize, and Sponsors reserve the right, in their sole and absolute discretion, whether or not to substitute a Prize (or portion of a prize) with a prize of comparable or greater value or cash value. If, for any reason, more than the stated number of Prizes are available and/or claimed, Sponsors reserve the right to award the Prizes by random drawing from among eligible Nominations or in a manner to be determined by Sponsors in their sole and absolute discretion. Non-compliance with these Official Rules may result in disqualification. A Winner will not be awarded a Prize until s/he has fully complied with these Official Rules. No transfer, assignment, cash redemption, or substitution of a Prize is permitted. Prizes are not exchangeable for cash, merchandise, or services.

11. GENERAL RELEASE AND WAIVER OF CLAIMS. By entering the Contest, being selected as a Potential, or by accepting a Prize, each Entrant and Winner hereby individually releases Sponsors, Contest Entities, and all of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, and all of their respective directors, officers, governors, employees, shareholders, and agents (collectively, the “Releasees”) from any and all liability, loss, harm, damage, cost, expense, or claims including, but not limited to, third party claims based on: (a) publicity and/or privacy rights, defamation, and intellectual property associated with the Entrant, Winning Nomination, or Winner’s participation in the Contest, redemption of any Prize in connection with the Contest, and/or use or misuse of any Prize in connection with the Contest, including, but not limited to, all reasonable counsel fees and court costs incurred, property damage, personal injury, and/or death; (b) anything related to the production, promotion, or execution of the Contest (or participation therein); and (c) anything that may occur in connection with acceptance and/or use of the Prizes or while participating in the Contest, even if caused or contributed to by the negligence of Releasees.

12. LIMITATIONS OF LIABILITY. Neither Sponsors nor any other Releasee shall be responsible for lost, late, incomplete, stolen, misdirected, illegible, or incomplete Nominations (or any component thereof). Neither Sponsors nor any other Releasee shall be responsible for any incorrect or inaccurate information, whether caused by Sponsors, Releasees, Entrants, or Winners, or by any computer, technical, or human error or malfunction that may occur in the processing or judging of Nominations, the administration of this Contest, or in the announcement of Prizes. Neither Sponsors nor any other Releasee shall be responsible for tampering or any of the equipment or programming associated with or utilized in the Contest, and neither Sponsors nor any Releasee shall assume responsibility for any error, omission, defect, theft, destruction, or unauthorized access to the materials related to the Contest, or for any damage to an Entrant’s or Winner’s computer related to or resulting from participating in the Contest or acceptance of a Prize. Sponsors reserve the right, in their sole and absolute discretion, to disqualify any individual found to be tampering with the entry/nomination process, the winner selection process, or the operation of the Contest; to be acting in violation of these Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent or apparent intent to annoy, abuse, threaten, embarrass, harm, or harass, in any way, any other person. If, for any reason the Contest is not capable of running as planned by reason of, but not limited to, business or market circumstances, force majeure, public health concerns and pandemics, including COVID, tampering, unauthorized intervention, actions by Entrants, potential Entrants, Winners, or potential Winners, fraud, or any other causes which, Sponsors in their sole and absolute discretion, deem could corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, or the Contest is otherwise not capable of running as planned, Sponsors reserve the right, in their sole and absolute discretion, to cancel, terminate, modify, or suspend the Contest. If such malfunction, error, disruption, or damage occurs, and it impairs the administration, security, fairness, integrity, or proper play of the Contest, Sponsors may, in their sole and absolute discretion, suspend or terminate the Contest or any portion thereof by posting a notice on the Contest Website or in participating Chick-fil-A restaurants. If the Contest or any portion of the Contest is terminated before the end of the Contest Period, Sponsors may select Winners from all eligible entries received as of the termination date of the Contest. IN NO EVENT WILL SPONSORS OR ANY RELEASEE BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, CLAIMS, ACTIONS, DAMAGES, LOSSES, OR LIABILITY OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM OR ARISING FROM PARTICIPATION IN, OR THE PRODUCTION, PROMOTION, OR ADMINISTRATION OF, THE CONTEST, OR ACCEPTANCE, POSSESSION, USE, MISUSE, OR NONUSE OF A PRIZE THAT MAY BE AWARDED, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WITHOUT LIMITING THE FOREGOING, ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD ANY SUCH ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

13. MISCELLANEOUS. Each entry/Nomination is subject to verification by Sponsors or their designees. Entrants and Winners hereby waive any right to claim ambiguity in these Official Rules.

14. CHOICE OF LAW. This Contest will be administered in the State of Texas, and by participating, all Entrants and Winners agree that all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of Entrants, Winners, Sponsors, and/or Releasees in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Texas without regard to conflicts of law/choice of law doctrine of Texas or any other jurisdiction. Entrants agree to the jurisdiction of Texas state and federal courts and waive any right to change of venue or any like right.

15. Disclosure of WinnerS. Winners’ List (first name, last initial, and city) will be posted on Contest Website.
